lemon law (i bought a new car and there’s a problem.)?

i bought a new car , and it has about 23000miles on it now. the warranty expires at 36000miles.
although its a new car, i found some noise problem generated from the rear window or trunk so i went to a local dealership and they fixed it. it was ok for a few days after the repair but the same noise started again after a week.

in this case, if the same problem persists even after three times of attempts to repair it, is it possible to get a full refund even though i drove it 23000miles?
according to the lemon law..

    You can’t return the car now. You can only return it within the buyer’s remorse period which usually lasts 2 days. All car dealerships give you that time to see if anything is wrong with the car so you can make sure you’re not getting gipped. My advice would just be selling it if it annoys you so much. I mean my car’s rear windows make an annoying sound when rolling down but nothing’s wrong with it. You probably just need some WD-40 sprayed in the right spots, because that happens on a lot of cars.

    btw what kind of car is it?

    i dont think so. the lemon law is a very specific piece of legislation in each state and a pia to go to court with.
    Remember that the people who give the most money to the politicians are the ones who benefit from anything that they call a law. So the voter always thinks he’s getting something but he never is.

    The Lemon Law (Song vs. Beverly act) is not as cut and dry as most people believe. While you certainly can claim there were multiple repair attempts to correct your concern, you really have not established the dealer was incompitent in correcting your concern.

    What you are entitled to at this point is an extension of your factory warranty for the number of days the vehicle was down while trying to correct your concern.

    The steps you have not taken to be eligilble for the Song vs. Beverly act is contact with the dealership’s area rep, followed by contact with the manufacturer. You would then also need to proceed with arbitration. After all of these steps have been exhausted, then you would be eligible to start proceeding with Lemon Law relief.

    In the state I live in the ” lemon law ” is only for 30 days.
    Even if they did allow it which I doubt, after 23000 miles I can’t see them giving you a full refund.
    You might want to check with the better business bureau to find out further info.
